It's when one person (the plaintiff), sues another person (the defendant), in small claims court, and wins the case. But are they really the winner? The easy part was winning the case. Now comes the difficult part, and that is getting the defendant to actually pay-up.

You see, the court cannot collect the money for you. It is actually up to you to collect your own judgments. But with no pressure to pay-up from the courts, and with the plaintiffs not knowing how to collect their winnings, the defendants, in 80% of the cases, walk away without ever paying the judgment.

Why is it so difficult for the judgment winners to collect their court awarded judgments? The primary reason is because they do not have the proper training. They do not know where to begin to collect what’s owed them. Let’s face it, how many people do you know that are trained to recover money judgments? Not many, if any. They don’t teach this type of stuff in school.

So what are the options? Most plaintiffs turn to a lawyer or a collection agency. But both will, in most cases, cost them more money than the judgment is worth. So the plaintiff gives up. They’ve wasted enough time and money. They move on knowing that they will never see a dime of their money. Their name is now added to the thousands of others who have given up trying to collect their money. Now you see why approximately 80% of court awarded judgments are never recovered.
